A Gaijin inJapanis a blog created onMay 4, 2011and whose main theme is the discovery ofJapan. Numerous articles on this topic can be written on this blog such as:

- stories and advices on travel toJapan

- Photos albums

- General informations aboutJapan

Anything related to near and far to Japan, without any limits if no ethics, decency and respect for laws.

2. Comments

www.gaijinjapan.org users are able to post comments on various articles and blog pages, except articles or pages where the comments have been disabled. A user must be at least thirteen (13) years old to post a comment on the blog.

2.1 Validation of comments

The first comment from a user must be validated by the editorial team of www.gaijinjapan.org before being published. Validation occurs when the comment respects ToU, the policy of the blog and Netiquette. Validation of a comment is at the sole discretion of the moderator of the blog. Under no circumstances does www.gaijinjapan.org guarantees a review period of your comment, and not to prevent the comment’s author in case of refusal of the blog or to justify its decision.

When the first comment is validated, then a commentator can post new comments that are published by default on the blog.

In the event that a commentary would not respect the ToU, the policy of the blog, netiquette or the laws, just contact us so we will delete the comment spam.

Publishing a comment on the blog is free of charge and does not entitle to any compensation against this part. You authorize the blog www.gaijinjapan.org to adapt the content of the comments when necessary to comply with the ToU of the blog.

You authorize www.gaijinjapan.org to reproduce and / or use all part of the content of comments for editorial purposes or for purposes of the blog and other related products thereof, without monetary compensation.

2.3 Right of correction

You have the right to modify or delete a comment that you may have published on this blog. To do so, simply contact us to make a request and we will reply as soon as possible

The blog www.gaijinjapan.org uses different networks at its disposal on the net to promote its business and this without any limits. 3.2.1 Use of Social Networks

Social networks are used solely for web marketing, to develop the audience and revenus of the blog. Only users who are thirteen (13) years or older can register on these groups. Registered users to these groups recognize the right of www.gaijinjapan.org to use data in accordance with the ToU of www.gaijinjapan.org and the referring sites (see the relevant social networks ToU), in compliance with the laws applicable inFranceand in the home country of the user. A newsletter is created on the blog, via the service provider AWEBER. The purpose of the newsletter is to communicate around the www.gaijinjapan.org blog and all its activities without limitations.

The newsletter subscribers acknowledge acceptance of the ToU of www.gaijinjapan.org. In case of disagreement or at their discretion, subscribers to the newsletter can unsuscribe from the newsletter by clicking the unsubscribe link at the bottom of the emails sent to them or by contacting us.

4. Monetization of the blog

A Gaijin in Japan/ Un Gaijin au Japon blog is a professional profit making (see disclaimer) blog. The users of www.gaijinjapan.org recognize that the blog contents or links in the blog can be generated for profit – sponsored articles, affiliate links, but are not limited.

www.gaijinjapan.org leaves an opportunity for surfers – called “contributors” – to publish articles and photos onJapan– called “content”, in respect of a defined framework – called Terms of Use (ToU).

• Age of the contributors

Contributors must be aged 18 or older at the time of writing in order to publish content to www.gaijinjapan.org and have full legal capacity (ability to legally act alone, and have your rights to the content addressed to www.gaijinjapan.org without authorization/respresentation by a guardian, trustee or another person). For example, persons under guardianship can not contribute to this blog.

• Authenticity of the content

The contributors are commited to being the exclusive authors of texts and images that will be published on the blog. A contributor can not publish content on a trip he has not realized by himself – for example the journey of a friend – or post photos he has not taken directly by himself.

Similarly, the contributor must not have already sold, ceded, abandoned all or part of his rights to the texts, pictures and videos.

• Copyright of the content

Contributors will check before sending content to have the necessary permissions – for example in the case of the publication of pictures of museums, buildings lit at night, or people. www.gaijinjapan.org assumes no liability concerning the origin of content.

Contributors to certify that they have the right to publish and distribute the images, videos and texts, in compliance with the legislation (copyright, image rights, …)

• Signature of the content

The contributor must sign – your name or pseudonym – his articles

If you made searchs for your articles, you should check that you have the right to use the content, to distribute / sell quote and the content source.

You must not plagiarize and copy / paste an existing article or paraphrase an existing section. The content that you post must be personal and unique.

The contributor will inform www.gaijinjapan.org of any changes to personal information given during registration, including any change of e-mail address.

• Protection of personal data

Accordance with the data protection act of6 January 1978, the users has, at any time, a right to access, modify, rectify and object date concerning himself. It may exercise this right by sending an email to my email address or mailing me directly, subject to proof of identity.

• Right to change

www.gaijinjapan.org reserves the right to change the items you have sent as a contributor. There are two cases:

1)      minor edit

www.gaijinjapan.org changes text in a minor way, to eliminate the awkward wording, spelling errors and / or typing. www.gaijinjapan.org amends a section for graphics or aesthetic reasons, without changing the meaning and philosophy of the text. In this case, www.gaijinjapan.org do not report this change to the contributor and the contributor can not make a claim on it.

2)      major edit

If an item needs to be changed significantly, for example to delete inadequate passages or add additional informations, www.gaijinjapan.org will signal its desire to amend the article by e-mail to the contributor before to make the change.

 In case of non-response within 72 hours, www.gaijinjapan.org will consider that the contributor accepts the change request and proceed wit necessary changes, without notifying the change to te contributor.

In case of refusal the contributor refuses the changes within 72 hours, the item will not be published.

• Acceptance of the content

Acceptance of the content is at the sole discretion of the editorial team of www.gaijinjapan.org blog. In case of refusal of an article, www.gaijinjapan.org may, in individual cases, provide details (which you can consider before sending new content). These details will only be sent if you request by e-mail.

• Copyright of the content

Te contributor agrees to transfer the copyright and all its rights to the content – text, photos, videos, without limitation – to www.gaijinjapan.org. Content published on www.gaijinjapan.org therefore belongs to www.gaijinjapan.org, as well as income related the reto. The contributor therefore undertakes not to (re-)use the content he posted on the blog for commercial purposes without first contacting the team of www.gaijinjapan.org and obtained written consent and express on his part.

Here, without limitation, some examples of use of said contents on a commercial basis:

(1)     the sale of content for travel brochures, other websites

In exchange for his cooperation, the contributor may be paid or promoting his blog in the articles he has published.

• Monetization of the blog

www.gaijinjapan.org can use the content posted by contributors in its sole discretion in order to generate pecuniary revenue. www.gaijinjapan.org is likely to directly or indirectly use the content published on other blogs and partner sites that the contributor can not claim any compensation or to be informed.

• Litigation for breach of copyright

In case of non-compliance with ToU, the relevant content will be deleted and undue ayments to the contributor as well as any damages must be paid back to www.gaijinjapan.org by the contributor.

In the event that an item of the contributor does not respect copyright – for example, an article copied / paste without permission – even though the copyright of the article and images were transferred to www.gaijinjapan.org at the sale of content by the contributor, this sale shall be null and void and will be cancelled for not having respected the site ToU and applicable national and international copyrighting.

The contributor, in addition to repayement of sums wrongly paid and any damages, will be liable to face criminal to the original author content; www.gaijinjapan.org and its partners can not be held liable for breach of copyright.

The content must always be given to www.gaijinjapan.org in good standing, in full compliance with the statutory basis, and net of any liability (civil, criminal, administrative …) and any obligation, permission, subject, …

The contributor, accepts and agrees to it b sending a content. In case of breach of this obligation (and this commitment), the contributor will remain personally liable for any damages / risk / litigation relating to the content in question, even after publication by www.gaijinjapan.org

7. Right to quote

As part of articles on this blog, company names can be cited to illustrate the words discussed in this blog. Trademarks belong to their respective owners. If your brand or company mentioned in this blog and you do not want to be listed, just contact us and we will make the necessary changes as quickly as possible.

The user of this blog agrees not to reproduce any content, whatever its form, without asking permission of the creator of this blog through the contact form.
